The short version. Hubionis is a place to find guided tours in Vietnam and to plan a trip around them. We are not the tour operator and we do not sell you the tour. When you ask for a place, the request goes to the operator running it, and everything that follows — confirming, invoicing, taking payment, cancelling — is between you and them, on their terms.
This page describes what we do and do not do. It replaces version 1.0, which described a ticketing platform we never became.
1.1. The Service is the website at hubionis.com and everything reachable from it. It is run by Cryptionis sp. z o.o., registered in Warsaw at the address above.
1.2. These terms apply to everyone who uses the Service, whether or not they hold an account.
1.3. In these terms, Operator means the company running a tour listed here. You means the person using the Service.

2.1. Hubionis publishes a catalogue of guided tours in Vietnam, together with information for planning a trip: seventeen destinations, month-by-month season ratings for the three regions, distances, and a checklist of the decisions a trip needs.
2.2. Hubionis also searches flights across airlines and booking sites and shows you where to buy. We do not sell the flight. Following one of those links takes you to the airline or agency, whose own terms then apply.
2.3. Hubionis is an information and introduction service. We are not a travel agent, a tour operator or a tour organiser within the meaning of the Act of 24 November 2017 on package travel and linked travel arrangements, and we do not assemble package travel.
3.1. Tours are listed in one of two ways, and the button on the tour page says which:
3.2. Sending a request is not a booking and does not commit you to anything. It is an expression of interest. Nothing is agreed until the Operator confirms your place, which they do by email.
3.3. We take no payment. The Service does not process card payments for tours, does not hold your card details, and issues no tickets. Payment is arranged directly between you and the Operator.
3.4. Prices shown are the Operator's, in the currency the Operator set. The page can convert that figure to another currency for reading, using published National Bank of Poland rates. A converted figure is an indication only; the amount you owe is the one the Operator invoices.
3.5. Availability shown on a tour page reflects what the Operator has told us and can change before they confirm.
4.1. Until the Operator confirms your place, you may withdraw a request at any time and at no cost, and so may they.
4.2. After confirmation, the contract for the tour is between you and the Operator. Cancellation terms, deadlines, refunds and any deposit are theirs and differ from tour to tour. Ask the Operator before you confirm. We do not set them and cannot vary them.
4.3. Complaints about a tour — how it ran, what was included, a refund — go to the Operator, who is the party you contracted with.
4.4. Complaints about the Service itself — a listing that is wrong, a broken page, your account — come to us at contact@hubionis.com. We reply within 14 days.
5.1. Browsing the Service is free and requires no account. An account is needed to request a place on a tour and to keep a trip you are planning.
5.2. Accounts are free. Registration requires an email address you control, and you must confirm it.
5.3. You are responsible for keeping your password to yourself and for what is done through your account. Tell us if you think someone else has it.
5.4. You may delete your account at any time from your account settings, or by writing to us. Deletion is covered in the Privacy Policy.
5.5. We may suspend an account that is used to break these terms, to impersonate somebody, or to send other users unsolicited commercial messages. Where we do, we say why.
6.1. Do not use the Service to break the law, to harvest other people's data, to send spam, or to place automated load on it beyond ordinary reading.
6.2. Do not copy the catalogue, the season data or the editorial text for republication elsewhere. Linking to a page is welcome.
6.3. Content you submit — a trip name, a message to an Operator — must be yours to submit and must not be unlawful or abusive.
7.1. We are responsible for the Service: that it is available, that it describes tours as the Operator described them to us, and that our own planning information is presented honestly.
7.2. Planning information — season ratings, distances, how long a route realistically takes — is guidance based on long-term averages and measured distances. It is not a forecast and not a guarantee. Weather in any given year may differ from the pattern.
7.3. We are not responsible for how a tour is run, for an Operator's solvency, for their cancellation terms, or for anything that happens on the trip. That responsibility is the Operator's.
7.4. We are not responsible for the content of external sites we link to, including airline and agency booking pages and news publishers.
7.5. Nothing in these terms limits liability that cannot be limited under Polish law, including liability for death or personal injury caused by negligence, or for intentional harm. Consumer rights under mandatory law are unaffected.
8.1. Entry requirements for Vietnam are set by the Vietnamese authorities and depend on your nationality. Anything we say about visas is a prompt to check, not advice: verify the current rules for your own passport on the official Vietnamese immigration portal, and allow time before you travel.
8.2. Travel insurance, vaccinations and fitness to travel are your responsibility, and may also be conditions the Operator sets.
9.1. The Service's design, text, season data and destination write-ups belong to Cryptionis sp. z o.o. and are protected by copyright.
9.2. News items are headlines and short extracts from the publishers named on each item, shown under the right to quote, with a link to the original. Copyright in them stays with the publisher. Any note we add beneath is our own editorial writing.
9.3. Tour descriptions and photographs supplied by an Operator remain theirs; they grant us permission to publish them here.
10.1. We may change these terms — for example when the Service changes, or when the law does.
10.2. Registered users are told by email at least 14 days before a change takes effect. Continuing to use the Service after that date means the new version applies. If you would rather not accept it, you may delete your account, at no cost.
10.3. A change never affects a request already confirmed by an Operator.
11.1. How we handle personal data — what we collect, why, how long we keep it and what rights you have — is set out in the Privacy Policy, which forms part of these terms.
12.1. These terms are governed by Polish law. If you are a consumer resident elsewhere in the EU, this does not deprive you of the protection of mandatory rules of your own country.
12.2. We would rather settle a complaint directly. If that fails, a consumer may use out-of-court routes including the provincial trade inspectorate (Wojewódzki Inspektorat Inspekcji Handlowej) and the European Commission's ODR platform at ec.europa.eu/consumers/odr.
12.3. Disputes not resolved that way go to the court with jurisdiction under Polish law.
12.4. If a provision of these terms is held invalid, the rest stands.
12.5. The Polish and English versions of this document are both published. In the event of a discrepancy, the Polish version prevails.
